Gregory M. Garrett, a partner in the Litigation Department, advises clients in commercial litigation disputes.  Although his experience includes general litigation, commercial and business torts, breach of contract, professional malpractice defense, and insurance coverage cases, he concentrates his practice in two areas: health care and antitrust/trade regulation.

He represents clients in the health care field in their defense of medical malpractice, commercial, privacy, and other claims.  His recent work for health care clients includes:

  • Defending a hospital in a lawsuit alleging defamation and tortious interference in connection with a contract between the hospital and a pharmacological product supplier; the hospital prevailed on a motion to dismiss.
  • Defending health care providers in a medical malpractice case; after discovery, the plaintiffs voluntarily dismissed their case.
  • Drafting a health insurance company’s internal policy governing how policyholder appeals will be handled.
  • Representing health insurers in coverage disputes.

In addition to his litigation work in courts throughout the State of Maryland, Mr. Garrett has also counseled clients on compliance with state and federal privacy laws, and helped them to develop best practices.

Mr. Garrett also defends corporations – especially those in the manufacturing and distribution industries – in antitrust, franchising, unfair competition, business tort, trade regulation, and constitutional law litigation.

In recent years, he has handled several complex matters, including:

  • Defending a cable service provider in a dispute involving claims brought by a terminated installer of cable services, with counts for defamation, antitrust violations, fraud, and promissory estoppel.
  • Defending a provider of internet security software in action brought by former software distributor for fraud and breach of contract.
  • Representing an advertising agency in claims for breach of fiduciary duty against ex-employees.
  • Assisting in successfully guiding numerous cases towards settlement through mediation, including a recent dispute on behalf of an international construction company sued for claims under the Maryland Equipment Dealers Act.

Mr. Garrett has served as lead and co-counsel in jury and non-jury trials and other matters in the Circuit Courts for a number of Maryland counties, the U.S. District Court for the District of Maryland, and the U.S. Court of Appeals for the Fourth Circuit, as well as the Office of Medicare Hearings and Appeals and the Office of Administrative Hearings.


Mr. Garrett served as vice-chair of the Exemptions and Immunities Committee of the Antitrust Section of the ABA.  Prior to his appointment, he served in the inaugural position as the Young Lawyer Representative on the Committee, and he has written numerous articles and book chapters on antitrust issues.  His article, "Brady v. NFL - Intentional Grounding of an Implied Antitrust Exemption," was published in the Antitrust & Trade Regulation Report in July 2011.  He is admitted to practice in the State of Maryland and a member of the Maryland State Bar Association.

Mr. Garrett has been recognized since 2010 by Maryland Super Lawyers magazine for his business litigation, professional liability defense, and products liability defense practices.

He attended the University of Baltimore School of Law, where he was an Assistant Associate Editor of the University of Baltimore Law Review.  He is a member of the Heuisler Honor Society, won first place in the Center for International & Comparative Law’s 2005 student essay competition, and was the Team Captain of The Jessup International Law Moot Court Competition.
