H-1B Filing Season Opens April 1, 2015

Hoping to hire new H-1B employees under the FY2016 H-1B cap for employment beginning October 1, 2015?  The first day to submit petitions for new H-1B employment is April 1, 2015. 

The U.S. Citizenship and Immigration Service (USCIS) grants H-1B status to 65,000 professional workers each year (plus 20,000 holders of U.S. graduate degrees), on a first-come, first-served basis.  As the economy improves, demand for new H-1Bs is growing.  Often, the cap is filled on or soon after April 1.  In other years, USCIS awards H-1Bs by a lottery system because it receives more petitions than the cap will allow.  Because we cannot predict the volume of filings in any year, we recommend that all H-1B petitions be submitted on April 1.  (Petitions for extensions of H-1B status or to transfer individuals with existing H-1B status to new employers may be filed throughout the year).
