Lee Rauch has practiced civil litigation since 1993, representing businesses and individuals in a wide variety of matters in Maryland, the District of Columbia, and elsewhere. A trial lawyer and appellate advocate, he focuses his practice on commercial litigation in federal and state courts.
Mr. Rauch regularly represents automobile dealers, a national provider of service contracts, and other automotive industry clients, defending them from claims of misrepresentation, consumer protection violations, breach of warranty, negligent servicing, and breach of contract.
In recent years he has:
- Won summary judgment for an auto dealership on consumer claims of identity theft;
- Won summary judgment for a national auto retailer on claims of breach of land sale contract;
- Won summary judgment for a commercial subleaser on claims brought by the landlord;
- Won a motion to dismiss for a closely-held company in a shareholder derivative suit; and
- Negotiated a successful settlement for a home improvement franchisor in a claim brought by a terminated franchisee.
Mr. Rauch has also handled arbitrations, mediations, and trials in cases involving:
- Complex commercial litigation including contracts, fraud and other business torts, shareholder/partnership disputes, and antitrust issues;
- Insurance defense and coverage;
- Personal injury;
- Disputes between developers and home buyers;
- Representation of commercial and residential landlords;
- Employment litigation;
- Products liability;and
- Medical malpractice.
Mr. Rauch has briefed and argued before Maryland’s Court of Appeals and Court of Special Appeals. Among the reported cases in which he has represented clients are:
- Case Handyman and Remodeling Services, LLC v. Schuele, 183 Md. 44 (2008), vacated on other grounds by 412 Md. 555 (2010) (holding that non-party to contract containing arbitration clause could compel arbitration when it was being sued in connection with the contract);
- Danielwicz v. Arnold, 137 Md. App. 601 (2001) (affirming trial court dismissal of shareholder derivative suit); and
- Osborn v. Bunge, 338 Md. 396 (1995) (granting motion to dismiss appeal for lack of final judgment).
Leadership
Mr. Rauch serves as Deputy Chair of the firm’s Litigation Department. He volunteered as a team leader and faculty member for the “Deposition Practice and Procedures” program held by the Maryland Institute for Continuing Professional Education of Lawyers from 2000-2009.
Mr. Rauch is a member of the Board of Governors of the Maryland Chapter of the Federal Bar Association. He also has been active in the American Bar Association's Tort Trial and Insurance Practice Section, having chaired its Trial Techniques Committee and Task Force on Outreach to Local and State Bars, among several other positions.
Since 2009, Mr. Rauch was named by Maryland Super Lawyers magazine as one of the top attorneys in Maryland for his general and business litigation practice. Only five percent of the lawyers in the state are named by Super Lawyers. The selections are made by the research team at Super Lawyers, which is a service of the Thompson Reuters, Legal Division.
