Mr. Marion is one of the region’s preeminent litigators, with more than 40 years experience trying cases in both state and federal courts. In the early 1960s, he prosecuted federal criminal cases as an Assistant United States Attorney for Maryland. In private practice since then he has represented both business and individual clients, in civil and criminal cases, both at the trial and appellate levels. He focuses his practice primarily in the defense of major corporations in complex civil matters.
Among Mr. Marion’s significant litigation experiences are:
- defense of IBM Corporation in 8-week trial brought by the EEOC alleging employment discrimination
- prosecution of two congressmen and two others for conspiracy and influence-peddling in 10-week trial
- defense of Sherwood Medical Corporation in 3-week trial brought by former distributor alleging tortious interference with contract
- prosecution of insurance swindler for mail fraud
- defense of ERISA plan administrator in suit charging breach of fiduciary duties
- defense of IBM Corporation in suit for alleged patent infringement
- defense of Stroh Brewery Company in suit brought by former distributor
- prosecution of civil breach of ERISA fiduciary claims on behalf of pension plan against former plan trustees and of malpractice claims against former plan attorneys
- prosecution of civil tort and warranty claims on behalf of tampon user who sustained toxic shock syndrome
- defense of IBM Corporation in hundreds of suits in Maryland, D.C., Virginia, and West Virginia, alleging repetitive stress injuries from use of computers or supermarket scanners, all of which were either dismissed before trial or won on motion before trial
- defense of Schlitz Brewing Company in suit brought by former distributor
Mr. Marion is also an accomplished appellate advocate, having appeared in dozens of appellate arguments in Maryland appeals courts, the United States Court of Appeals for the Fourth Circuit, and the New York Appellate Division.
