Mr. Bushel, a partner and member of the firm’s Management Committee, has represented a broad spectrum of clients in civil litigation for over thirty years. He has extensive experience litigating in state and federal courts and before administrative agencies. He has achieved favorable results in various areas of commercial litigation, including construction-related disputes, banking law, real estate, and estates and trusts. In the area of employment law, Mr. Bushel has defended numerous entities against allegations of discrimination. He is also an established authority in the area of equine litigation, having represented clients in the horseracing industry for three decades.
With every matter, Mr. Bushel proceeds according to the assumption that the case will go to trial, working toward an efficient resolution of the matter. In addition to his role as a courtroom advocate, he is an experienced negotiator and mediator of complex commercial disputes.
Representative Cases
Over the course of his career, Mr. Bushel has:
- Represented a plaintiff corporation in a case in which the client accused two former officers of breaching their duty of loyalty after they established a competing company; a five-day trial resulted in a jury verdict in favor of the plaintiff, which recovered several hundred thousand dollars;
- Represented a defense industry contractor in a series of procurement cases against the U.S. Navy, where the client sought payment for work completed on behalf of the government; two cases went to trial in federal court and led to judgments for the plaintiff; a third case settled favorably for the client;
- Been active in several construction cases; he currently represents a supplier of building materials seeking payments for materials supplied for a residential development; he is also defending a developer against a claim brought by a condominium association in connection with the construction of a marina on Maryland’s Eastern Shore;
- Procured the U.S. Supreme Court's review and reversal of the district court in Hughes v. Alexandria Scrap Corp., 426 U.S. 794; and
- Defended Tartan Farm's 1980 Preakness victory before the Maryland Racing Commission, won by Codex; he has achieved favorable results in numerous other equine-related cases.
Leadership/Public Service
Mr. Bushel is currently a member of the Peer Review Committee of the Attorney Grievance Commission of Maryland and participates in the Circuit Court for Baltimore City's Mediation Program. He served as an Assistant Attorney General of Maryland and as a hearing officer for peer review proceedings concerning physicians' hospital privileges. He has lectured before the Judicial Institute of Maryland and was the Reporter for the Governor's Commission on Racing Reform.
Since 2007, Mr. Bushel has been named by Maryland Super Lawyers as one of the top attorneys in Maryland for his general litigation practice. Mr. Bushel is also AV® Peer Review Rated – the highest possible peer review rating from Martindale-Hubbell.
