For over 27 years, Diane D’Aiutolo has represented a variety of clients in commercial litigation in state and federal courts. A trial attorney, she also has extensive experience in resolving disputes through mediation, arbitration, and other out-of-court alternatives. Ms. D’Aiutolo concentrates her practice in medical malpractice and products liability defense, as well as commercial and contractual disputes. She is especially experienced in the healthcare field, representing hospitals and HMOs in litigation, serving as outside general counsel to numerous physician practices, and counseling clients in connection with risk management, claims, and transactional matters.
Representative Matters
- Won summary judgment for a hospital in a case involving a nine-court complaint seeking $100 million dollars.
- Defended a hospital in a lawsuit alleging defamation and tortious interference in connection with a contract between the hospital and a pharmacological product supplier; the hospital prevailed on summary judgment.
- Defended a hospital in a lawsuit alleging defamation and tortious interference in connection with a lawsuit filed by a medical device salesperson; the hospital prevailed on a motion to dismiss.
- Has successfully guided numerous cases towards settlement through mediation; recently mediated a dispute on behalf of an international construction company sued for claims under the Maryland Equipment Dealers Act.
- Drafted a health insurance company’s internal policy governing the handling of policyholder appeals.
- Drafted numerous employment contracts for physician practices.
Ms. D’Aiutolo’s current caseload is concentrated in federal and state courts in Baltimore City and the surrounding suburban counties. She also represents clients before various licensing boards, including the Board of Physicians.
Public Service
Ms. D’Aiutolo served as the Maryland State Representative to the Defense Research Institute, President of the Maryland Association of Defense Trial Counsel, the Board of Directors of Commercial Law Affiliates (now Meritas), and on the Commission of the Maryland Judiciary on Pro Bono. She is currently a certified settlement facilitator for the District Court of Maryland and Maryland Volunteer Lawyers Service, Inc.
In 2012, Ms. D’Aiutolo was named one of Maryland’s Top 100 Women by The Daily Record. This is the second time that Ms. D’Aiutolo has been selected as one of Maryland’s Top 100 Women. This annual award recognizes leadership roles and other outstanding achievements of professional women who reside and work in Maryland and who are making an impact on the state. In 2011, she was elected President-Elect of Network 2000. Ms. D'Aiutolo is AV® Peer Review Rated – the highest possible peer review rating from Martindale-Hubbell.
Prior to joining Tydings & Rosenberg, Ms. D’Aiutolo served as a law clerk to Judge Elsbeth L. Bothe of the Circuit Court for Baltimore City.
